Park Improvement District - The Process
Park Improvement District PKID projects are managed through a process that encourages citizen participation:
Early each year, Gilbert invites residents from each PKID neighborhood to attend a meeting. Notification of the meeting is mailed. Typically, meetings are held at the Public Works Facility at 900 E. Juniper Road or the Municipal Center at 50 East Civic Center Drive.
Residents and staff members discuss park and/or right-of-way improvements. Contractors bid on contracts for each of the 11 individual neighborhoods. The Town hires and oversees the contractors responsible for berm maintenance, weeding, mowing, spraying, fertilizing, trimming, pruning, seeding, replanting, cleaning, raking, safety and replacing dead trees and plants. Projects such as playground and sports equipment or picnic table and park bench installation or replacement and common wall maintenance, etc. are contracted out to specialized companies that go through the Gilbert bidding process.
At the neighborhood meeting, Gilbert staff recommend improvements to rights-of-way, retention basins, common landscaped areas, facilities, equipment lighting and/or parks. Residents who are present at the meeting may approve the proposed project or recommend alternative improvements. Improvement costs are included in the next fiscal year’s budget. Projects initiated must be in the scope of each neighborhood’s master plan. Projects not in the approved plans cannot be implemented according to state statutes.
With input from Gilbert staff and residents, the annual budget is developed and then goes before the Council for approval. Following a public hearing, PKID costs appear as part of a special taxing district on each owner’s property tax bill, and Maricopa County collects the taxes for Gilbert. Tax amounts differ from neighborhood to neighborhood depending on the amount of property and the types of amenities. Each lot within a PKID is assessed the same amount.
PKID residents are always welcome to meet with Town staff to share ideas regarding maintenance and to make suggestions on future improvements.
While neighborhoods that are PKIDs may have covenants, codes & restrictions (CC&Rs), most do not have homeowners associations (HOAs) that are organized to enforce them. As with all land CC&Rs, PKID CC&Rs may be enforced by private individuals civilly. Unlike HOAs, PKID neighborhoods do not own common property and do not hire property management companies to maintain their neighborhoods. The Gilbert Community Services hires and oversees contractors who “bid” for individual contracts for each of the 11 neighborhoods. PKID projects are funded through taxing neighborhood property owners. The funds for operation and maintenance of the PKID are collected as a special assessment tax district on the regular property tax bill. The annual budget amount is developed by staff, (including any input from the neighborhood) and then adopted by the Council. There is an annual mailing to each address in each PKID letting them know about the proposed assessment amount and the budget.
Arizona Revised Statutes (A.R.S.) Section 48-574 (D) require Gilbert to levy taxes on all property in PKIDs to pay for the annual expenses. Taxes are adopted following notice and a hearing. A.R. S. 48-574 (E) Maricopa County is the assessing and collecting authority for the Town. PKID district costs are added to PKID resident property tax bills on a per lot basis.
