Section 504 Grievance Procedures
It is the policy of the Town of Gilbert to comply with all Federal and State laws, including Section 504 of the Rehabilitation Act of 1973 which states in part that "no otherwise qualified handicapped individual in the United States...shall, solely by reason of...handicap, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity.”
This procedure is established to ensure citizens and employees of a prompt and fair disposition of grievances under Section 504 of the Rehabilitation Act of 1973.
A grievance as defined herein shall consist of a completed Section 504 Complaint form submitted by any person, including any citizen and/or employee. Upon request, staff assistance will be provided to any individual who needs help preparing or submitting a Section 504 Complaint because of a disability.
Individuals who wish to file a Section 504 Complaint shall submit a Complaint form to: Town of Gilbert Human Resources Division - Section 504 Coordinator, 50 E Civic Center Drive, Gilbert AZ 85296.
Upon receipt of a Complaint, the Section 504 Coordinator shall investigate the alleged Section 504 violation and provide written findings and recommendations to the aggrieved party(ies) within thirty (30) days of receipt of the Complaint.
Within (30) days of receipt of the Section 504 Coordinator’s written response, the party or parties alleging the Section 504 violation shall have the right to appeal the Section 504 Coordinator’s findings and recommendations to the Town Manager.
An appeal as defined herein shall consist of a letter or memo to the Town Manager stating why the Section 504 Coordinator’s findings and recommendations are inadequate to resolve the problem.
The Town Manager shall conduct a review of the Section 504 Coordinators written response and a hearing for the complainant or the complainant’s representative (or both), to elaborate on the facts and circumstances that led to the Complaint. The Town Manager shall render a final decision within thirty (30) days of the date the appeal was received.
The Town of Gilbert does not discriminate on the basis of race, color, religion, national origin, age, handicap, or veteran status in the provision of educational opportunities or employment opportunities and benefits, in compliance with Title VII of the Civil Rights Act of 1964, and Section 504 of the Rehabilitation Act of 1973.
